Quality Conveyancing could be the difference to prevent abortive home moves

A recent report on 15th July 2011 shows a 29% fall through in property transactions in the first half of this year - up from just 21% three years ago.

Whilst a buyer and seller may not be totally honest as to why they choose to withdraw, a simple change of mind is often a reason. Economic uncertainty is the speculated major reason with fears over finances and job security with a reported one in ten sales falling through because of lack of mortgage finance.

Of course adverse survey reports are also reported as a continuing factor.

But with ‘cheap conveyancing’ littering the internet, and many Corporate Estate Agents referring every customer they can get their hands on to use their preferred conveyancers despite many having a very poor reputation - the quality of a buyer or seller’s chosen conveyancer will also play a major part in whether a transaction unnecessarily aborts. 

Clearly those conveyancers who are prompt in their dealings and who bring their client to an exchange without undue delay will help minimise the chance of either party getting cold feet. Toby Barrett asked to speak on BBC Radio Sussex about Compensation Culture

Toby Barrett was recently asked to speak on BBC radio Sussex “breakfast” show regarding the Compensation Culture.

Toby expressed the view that it is more a perception then reality.

“The problem is a perception. An industry of middle men has grown, advertising on the TV, radio and net. These companies advertise for accident victims to contact them and thereafter sell the resultant claims to law firms. When we watch our TV’s or turn on our radio we are bombarded with these adverts. This leaves us with the impression that Jo Public is claiming for anything and everything.”

Whilst there are devises that an injured Claimant can and should use to protect themeselves against cost liability (no win no fee, after the event insurance or before the event insurance) the usual rule is that the losing party pays the winner’s costs. The cost of litigation paid by Defendants would be a fraction of what it is were Defendants to avoid taking an unrealistic stance on liability and were Defendants to make realistic offers at an early stage.
