Smoking in the workplace

Smoking will be banned in workplaces with effect from 1 July 2007 across England. Employers will need to act now to comply with this legislation by:-

  • Reviewing any current smoking practices in the workplace
  • Communicating the changes to all employees and visitors
  • Introducing a smoking policy if you do not have one or amending an existing policy
  • Reviewing staff safety issues for those employees leaving the premises to smoke
  • Reviewing disciplinary procedures with regard to enforcement
  • Considering whether to offer support and counselling to staff trying to give up smoking
The onus is on the employer to implement the smoking ban. Failure to do so leaves the employer not only open to criminal prosecution but also to claims from employees or visitors that they have been injured through exposure to smoke.
