Fatal Accidents – What Can be Claimed?

Damages under the Law Reform (Miscellaneous Provisions) Act 1934.

The Estate of the Person who has died can claim for:

  • Damages for pain, suffering and loss of amenity if there was any suffering before death.
  • Loss of income between the time of the accident and death.
  • Funeral expenses.
  • Care expenses.

Damages under the Fatal Accidents Act 1977.

Dependents can claim for:

  • A dependency claim for the financial losses suffered by the dependent.
  • Bereavement damages.
  • Funeral expenses if paid for by the dependent.

Take care! There are complex limitation provisions. Bennett Griffin have had to bring a claim against the Negligent party under one Act and previously acting solicitors in relation to the damages that would have been payable under the other Act had limitation not been missed.
