The New Divorce Law – The Possible Pitfalls As To Resolving Related Issues

No Fault Divorce

On the 6th of April a new divorce law was introduced, dubbed the ‘no fault divorce’ bill. The bill means that divorcing couples will no longer be required by law to specify fault when legally separating. Previously, couples were required to prove that their marriage had broken down through one of the following five facts;

  • Adultery
  • Unreasonable behaviour;
  • Two years separation and consent;
  • Desertion; or
  • Five years separation.
