Unfair dismissal qualifying period

Following a recent enquiry from a client who runs a local business it would appear some Employers are still unaware that the qualifying period for an employee to claim unfair dismissal was increased from one year to two from 6 April 2012.

To clarify – employees with a contract dated 5 April 2012 or before only have to have one year’s employment to bring a claim but any employee with a contract dated 6 April 2012 or later must be employed for two years or more to bring a claim of unfair dismissal

This does not affect an employee’s right to bring a discrimination claim from the date employment commenced.
