Many property owners assume that the boundary between them and their neighbour’s property is simply a straight line, but this is often not the case.

Boundaries differ and vary over time. Sadly they can become contentious issues between parties, which is where boundary dispute solicitors can help.

    What Are Boundary Disputes?

Put simply, a boundary dispute is a dispute that arises between owners or occupiers of neighbouring properties.

Having an accurate idea of where boundary lines are is not always straightforward.

Sometimes a boundary dispute will arise when one party puts a fence, wall or building in a position that highlights that the two neighbours have different views as to where the boundary lies.

    How Boundary Solicitors Can Help

It is safe to say that by the time you are looking to instruct a boundary dispute solicitor, feelings between parties will have already become quite tense.

You have documents in front of you – often using language you are struggling to understand, or they’re handwritten so you can’t quite work out what it means – along with plans that don’t appear to match with what the document says.

If things become particularly fractious, litigation can become necessary (read more about settling boundary disputes with litigation). You can then quickly find that the cost of boundary disputes escalate.

That’s why professional help and advice is often needed to help solve boundary disputes.

Why Choose Bennett Griffin As Your Boundary Dispute Solicitors?

At Bennett Griffin, we can compile, review and assess all of the documents in relation to your property.

If need be, we can obtain the documents from the Land Registry (although it is always best to have these from you directly, so we can be sure we have everything to ensure our advice is up to date).

We will then work through the deeds and title plans – which can include those for multiple surrounding properties if required – and provide you with a detailed report of our findings.

We can suggest a surveyor who will be able to measure and set the exacting boundaries for you.

Working With Land Registry To Change Boundaries

Once the exact boundaries are determined, and should the land boundaries need to be amended with the Land Registry directly, we also have experience in completing and submitting applications.

If need be, we can pursue matters to the First-Tier Tribunal to ensure the linage is formally determined and to ensure that there are no further boundary issues moving forward.
